REGULATIONS OF FILM SPRING OPEN WORKSHOP 2024

I. Film Spring Open Workshop for filmmakers.

1. Film Spring Open Workshop (herein referred to as FSO) is organized by Film Spring Open Foundation (herein referred to as „Organizer”).
2. For 19 years already the Film Spring Open Workshop (“FSO”) has provided interdisciplinary and interactive workshops focused on the future of the audiovisual industry. In times of dynamic technological changes the aim is to provide the necessary continuous training and improve acquired artistic and technical skills among students and graduates of film schools as well as professionals and emerging talented filmmakers.
3. Film Spring Open Workshop is open to all individuals that represent one of the professions needed in film production (i.e. producers, directors, cinematographers, set designers, script writers, actors, composers, sound artists, editors, VFX, SFX, as well as programmers and authors of new AV forms).
4. Film Spring Open Workshop program includes:

• Discussion panels about the future-oriented new sustainable model of film production,
• Lectures about new possibilities to finance films in Europe,
• Workshops on new technologies including presentations and tests of newest tools for production and postproduction,
• Cooperation of creative groups searching for a new format of a film show (creative groups of i.e. producers, directors, cinematographers, set designers, script writers, actors, composers, sound artists, editors, VFX, SFX, as well as programmers),
• Workshops on digital postproduction including presentations and lectures,
• Meeting with outstanding filmmakers,
• Presentations of newest tools used on the set.

6. During Film Spring Open Workshop, participants will have the possibility to learn theory and consult their future projects.
7.  The registration fee will be returned to those persons who resign from the participation in the Film Spring Open Workshop by informing the organizers in writing no later than 2 weeks before the day of the start of Film Spring Open Workshop. The Foundation will deduce 10% of administrative fees from the returned fee.

II. Participants

1. The participation in FSO is paid 400PLN. Payment is made through the iMoje online service after the confirmation sent by the Organisers by e-mail. The information about acceptance of application will be sent to the e-mail address provided in the application.
2. Film Spring Open Workshop is planned for approximately 300 adult participants related to the film industry (students and graduates of film and theatre schools and film professionals).
3. In exceptional cases, the Organizer may allow a minor aged 16 or over to participate, following an individual assessment of their application. The final decision regarding the admission of a minor rests with the Organizer. In such cases, the written consent of a parent or legal guardian is required. The Organizer is not required to provide reasons for rejecting a minor’s application. The Organizer may make the minor’s participation conditional upon the presence during the Film Spring Open Workshops of a parent, legal guardian, or another adult designated in writing by the parent or legal guardian. The minor remains under the responsibility of their parent or legal guardian.

5. The registration is open for both individual filmmakers and dedicated groups. Organised groups are requested to send additional information by e-mail to: biuro@filmspringopen.eu
6. Organiser will confirm the registration within 7 days after the closure of the registration.
7.Accommodation can be booked by contacting the participants with the Hotel Forest in Krakow. Only participants who pay the registration fee will be able to book accommodation.
8. Final confirmation is made after the payment is made.
9. The registration fee will be returned to those persons who resign from the participation in the Film Spring Open Workshop by informing the organizers in writing no later than 2 weeks before the day of the start of FSO. The Foundation will deduce 10% of administrative fees from the returned fee.

III. Film Spring Open Workshop

1. FSO will take place between 13-22 of October 2026 on the Internet at www.filmspringopen.eu and through links to individual events.
2. FSO schedule (detailed program) will be available on the website filmspringopen.eu just before the start of the FSO.

Rights and Obligations of Participants and Organizers

1. The Organizers will provide substantive support to the Participants of the Film Spring Open Workshop who qualify for the work of dedicated groups.

2. The Organizer does not cover the costs of meals and accommodation for the Participants of the Film Spring Open Workshop.

3. The Organizer is not responsible for the destruction of the property of the Participants of the Film Spring Open Workshop, nor for the loss of valuable items during the Workshop.

4. The Organizer has the right to change the date of the Film Spring Open Workshop as well as the program, of which the Participants will be informed on the portal’s website.

5. Participants undertake to comply with state guidelines regarding the epidemic situation in the country in which they are staying and will carry out projects.

6. The Organizer reserves the right to make changes to the program as well as to the mode of implementation of the workshops resulting from the epidemic situation applicable at that time.

7. Participants are responsible for damages caused by their negligence.

8. The Organizer does not insure Participants taking part in the Film Spring Open Workshop and does not bear any responsibility in this respect.

9. The Organizer does not allow filming of scenes that are illegal or dangerous for the Participants or third parties.

10. Participants undertake to maintain safety on the film set. In this respect, the Organizer has the right to intervene in activities dangerous to the health of the Participants, in particular to forbid or order the Participants to cease such activities.

11. Copyright to projects created during the workshops remains with the Participants, except for the Advertising Film Group, in which studio projects will be created on the theme “Kraków. This is where I want to live” based on the Brief made available on the website, within the scope specified in point 12.

    The co-organizer of the Advertising Film Group organized as part of the Outdoor Workshops is the Krakow Festival Office, headquartered in Kraków (hereinafter: KBF). KBF may select one or more films produced within the Advertising Film Group during the Workshops for the purpose of purchasing the economic copyrights from the selected author(s)/co-author(s) to the selected screenplay and the film produced on its basis, in accordance with the principles described below:

    a) The total amount allocated by KBF as remuneration for the acquisition of economic copyrights to screenplays and films shall not exceed PLN 15,000 gross (fifteen thousand Polish zloty gross). The final number of selected screenplays and films, as well as the final amount of remuneration that KBF intends to allocate for the acquisition of rights, shall remain at KBF’s discretion.

    b) In order to specify the terms of the transfer of economic copyrights to the screenplay and the film, an appropriate agreement shall be concluded with the author(s)/co-author(s), under which the economic copyrights to the screenplay and film in the fields of exploitation specified in the agreement shall be transferred to KBF in exchange for remuneration. The conclusion of such an agreement shall be a condition for payment of the remuneration referred to above.

    c) Films selected by KBF for which the agreement referred to above has been concluded may be used, among other purposes, for promoting the City of Kraków, in particular on websites administered by the Partner, the Partner’s Facebook social media profiles, the Krakow.pl website, websites administered by the City of Kraków, or on YouTube; however, specific details shall be defined in the agreement.

    d) The Organizer shall provide KBF with the contact details of the creators of the selected films for further communication purposes. In such cases, KBF shall act as a separate controller of the personal data of those creators.

    e) Agreements between the creators and KBF shall be concluded directly by the interested parties. The Organizer shall not act as an intermediary in these activities.

    f) KBF is not obligated to select or acquire rights to any screenplay or film.

12. Participants grant the Organizer a non-exclusive, free of charge, perpetual, and worldwide license to use film materials created during the Outdoor Workshops for promotional purposes in current and future Film Spring Open activities. Participants also grant KBF — however, exclusively with respect to film materials created within the Commercial Film Group organized as part of the Outdoor Workshops (of which KBF is a co-organizer) — a non-exclusive, free of charge, perpetual, and worldwide license to use such film materials for promotional purposes in current and future KBF activities, in the following fields of exploitation:

• sharing on the website and via the Internet,
• broadcasting on television and at events organized by the Organizer,
• copying and transmitting in any manner, in whole or in part, to an unlimited number of users,
• using in whole or in part for the promotion of subsequent editions of the Film Spring Open Workshop and for the promotion of other activities of the Organizer,
• placing the created materials in the Archive on the website www.filmspringopen.eu

13. Participants are obliged to include in the end credits of film materials created during the Film Spring Open Workshop the Film Spring Open Foundation logo. (download). In the case of film materials created during the Advertising Film Group, Participants undertake to include the KBF logo in the end credits on a mandatory basis.

14. The Participant consents to the processing of their personal data in accordance with the currently applicable provisions of law on personal data protection, i.e., Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (GDPR), as well as the Act of 10 May 2018 on the protection of personal data. 15. Participants of the Film Spring Open Workshop are obliged to read and comply with these regulations. Participants confirm having read the regulations by accepting the conditions during online registration.

16. In case of non-compliance with these regulations, Participants will be asked to leave the Film Spring Open Workshop.
